[DRAFT: PENDING SOLICITOR REVIEW]

Structure and plain-English wording are in place. The final liability wording must be confirmed by a UK solicitor before this page is treated as binding.

Note for review: this document covers use of the website only. The package travel contract lives at booking terms. The two must not be merged, because the statutory duties of a package organiser attach to the booking contract and not to website use.

We are pre-launch. Nothing is on sale on this website yet. Trips open for booking on 1 January 2027, and until then every price you see is indicative and every call to action joins the waitlist rather than starting a booking.

Draft prepared June 2025 · not yet in force

1. What this page is, and what it is not

These are the terms on which you may use this website, join the waitlist and download anything we publish, such as our Nairobi cost guide. They apply to every visitor. By using the site you accept them. If you do not accept them, please do not use the site.

These terms are not a travel contract and nothing on this page commits either of us to a trip. The contract for a trip is set out separately in our booking terms, and those terms only start to apply once you have approved a written, line-item itinerary.

2. Who runs this website

This site is operated by Rudi Experience & Co Limited, registered in England and Wales, company number 17496458. Rudi Xperience is a trading name of that company. Our postal address is available on request by email.

We are a package organiser. That means when we sell a trip, we sell it as the organiser of the package and we are responsible to you for the package as a whole. We are not a travel agent and we do not act as an intermediary between you and a supplier.

3. Prices and information on this site

Prices on this site are published in pounds sterling. GBP is the authoritative currency for everything we quote. Where the site shows a price in US dollars or Kenyan shillings, that figure is an indicative conversion shown for convenience only, calculated at a rate we set periodically. It is not an offer in that currency and it is not the price you would pay.

Prices are shown as "from" prices, are per person, and describe what the accompanying includes list describes. They are not a quotation. A quotation is only ever a written itinerary issued to you, and only the figures in that itinerary are binding.

We work hard to keep the site accurate, but content is provided for general information. Availability, park and entry fees, supplier terms and exchange rates all move. Please do not treat anything on this site as advice you can rely on without speaking to us.

4. Flights are never sold on this site

We do not sell, arrange, book or ticket flights, and no page of this site should be read as offering to. Travellers book their own international and domestic flights directly with an airline or a licensed flight retailer. Any flight timings mentioned on the site are illustrative context for ground arrangements, nothing more.

5. The waitlist and the free guide

Joining the waitlist registers your interest. It is not a booking, it does not reserve a date, a price or a place, and it does not create any contract for travel. You may leave the list at any time using the unsubscribe link in any email we send you.

Guides and other downloads we publish are free, are for your personal use, and are provided as general information about what travel in Kenya typically costs. Figures in them are examples, not quotations.

6. Using the site properly

You may view, print and download pages of this site for your own personal, non-commercial use. Please do not scrape the site, republish our itineraries or pricing as your own, attempt to interfere with the site or the systems behind it, or introduce anything malicious. Please do not submit anyone else’s personal details to our forms without their knowledge.

7. Our content

All text, itineraries, pricing structures, photography, logos and design on this site belong to us or to our licensors and are protected by copyright and trade mark law. Photography credited to third parties remains theirs and is used under licence. Nothing on this site grants you a licence to reuse our content commercially.

8. Links to other websites

Where we link out, for example to an airline, an insurer, a park authority or a government visa service, we do so because we think it is useful. Those sites are not under our control and we take no responsibility for their content, their pricing or their terms. Please read their terms before relying on them.

9. Availability of the site

We aim to keep the site available but we do not promise that it will be uninterrupted or error free, and we may change, suspend or withdraw any part of it without notice. We may also change these terms. The version published here is the version that applies, so please check it when you visit.

10. Our responsibility to you for the site

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are not affected.

Subject to that, we are not responsible for loss or damage arising from your use of the site where it was not foreseeable, for business losses, or for loss caused by content on a website we have linked to. Our responsibility for a trip, once you have booked one, is governed by our booking terms and by the Package Travel and Linked Travel Arrangements Regulations 2018, not by this page.

11. Your data and cookies

How we handle personal data, including waitlist signups, enquiry details and counts of scans of our printed QR code, is set out in our privacy notice. Please read it alongside these terms.

This site sets only essential and functional first-party cookies. It loads no analytics, advertising or third-party tracking technology, so there is nothing for you to opt into. Every cookie we set is listed by name, purpose and lifetime in the cookies section of our privacy notice, and you can block all of it in your browser at any time.

12. Law and jurisdiction

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
